Health & Safety at work etc. Act 1974

Produce a Health and Safety Policy

You must provide a written policy if you employ more than five persons.  This document must detail the organisation and arrangement for health and safety within your business (Section2(3), Health and Safety at work etc. Act. 1974).

Undertake Risk Assessment

You must undertake a risk assessment of all your business's operations and functions.  If you employ more than five persons you must record any significant findings (Reg.3, The Management of Health and safety at work Reg. 1999).

Legal Enforcement

The Health and Safety At Work etc. Act 1974 is enforced by the The Health and Safety Executive and the Local Authority (Environmental Health Officers), they have the authority to serve:-

  • Improvement or Prohibition Notice, or
  • Prosecute, which if successful, may lead to a fine of up to £20,000 or 2 years imprisonment.
